I. ACCEPTANCE OF THE GENERAL CONDITIONS OF VENTE

Any confirmation by the Customer of a command(order) seized on the site take the membership(support) without reserve of this last one on the present General Conditions of Sale, except particular conditions granted in writing by FOIE GRAS QUILLOT. The fact that FOIE GRAS QUILLOT does not take advantage, at some point, of the one some of the present General Conditions of Sale, cannot be interpreted as being worth renunciation to take advantage of it later. The parts(parties) agree that FOIE GRAS QUILLOT can bring any modifications to the present General Conditions of on-line Sale and invites the Customer to every new command(order) to read again attentively the General Conditions of Sale current.

II.VALIDITY OF THE OFFRE

The offers of products put on sale on the web site are valid during the period of on-line presentation(display) and within the limits of available stocks. The offers are valid for any on-line made purchase

III. COMMANDES

3.1 Recording and confirmation of the command(order)

The data registered(recorded) by FOIE GRAS QUILLOT at the time of the confirmation of the command(order) establish(constitute) the proof of the transactions(deals) crossed(spent) between FOIE GRAS QUILLOT and his(her) Customers. This confirmation is communicated to the Customer by e-mail recapitulating the commanded(ordered) products, the delivery address, the chosen means of payment (on-line or by check) and indicating a number of command(order). The information expressed by the Customer during the grip(taking) of command(order) engages(starts) this one: in case of error of the Customer in the wording of his address and phone number(coordinates) or those of the place of delivery, having for consequence the loss of products, the Customer remains held the payment of the lost products. Any command(order) with choice of payment by bank card or payment card is considered as actual only when the concerned centres of payment gave their agreement. In case of refusal of the said centre, the command(order) is automatically cancelled and The Customer prevented(warned) by an electronic message. The Commands(Orders) passed on in FOIE GRAS QUILLOT are irrevocable for the Customer, except written acceptance of our part.

3.2 Modification of the Command(Order) - Periods(Delays)

To satisfy his(her) Customers, FOIE GRAS QUILLOT set up very short periods(delays) of preparation of the commands(orders) and the sending. Any demand of modification of the composition or the volume of a command(order) crossed(spent) by a Customer can be taken into account only before the expedition(shipping) of products by FOIE GRAS QUILLOT, and by every possible means written reached FOIE GRAS QUILLOT. In case of modification of the command(order) by the Customer, FOIE GRAS QUILLOT will be loosened from periods(delays) agreed for its execution. If FOIE GRAS QUILLOT does not accept the modification or the cancellation of the command(order), the paid(poured) deposits(advances) cannot be restored. If the commanded(ordered) product turns out unavailable and if FOIE GRAS QUILLOT cannot execute the delivery for the periods(delays), FOIE GRAS QUILLOT reserves the right to bring at any time any modification of caskets and makes a commitment to replace the product commanded(ordered) by an equivalent reference. It is up to the Customer to verify, during the Command(Order), during the possible against indications before consumption of products. The resale of articles acquired on the site is strictly forbidden and will be the object of pursuits by FOIE GRAS QUILLOT

IV.DELIVERY

4.1 Conditions

The expedition(shipping) of the Command(Order) cannot be made without the complete payment of Products and transport costs. FOIE GRAS QUILLOT reserves the right to cancel any confirmed command(order) which would not be settled(adjusted).

4.2 Modalities

The delivery is assured(insured) by post or by a carrier. Commanded(ordered) articles are delivered to the address to indicate by the customer in his command(order). The customer is anxious to verify the state of the delivered products and to inform in case of neglect or degradation with the carrier, by registered letter with recorded delivery, within 72 hours about the delivery.

V.RECEPTION / COMPLAINTS

Without prejudice capacities(measures) to be taken by the Customer towards the Carrier such as described in the article 4, the possible contestings concerning the quality, the quantity, the type of supplied Product and any visible vice(defect) must be carried(worn) in our knowledge within 48 hours by the delivery by registered letter with recorded delivery sent to FOIE GRAS QUILLOT, by clarifying the number of the concerned invoice and your Customer number. As regards the latent defects, they must be notified to us within 24 hours of their observation. It will be up to you to supply all the justifications as for the reality of the vices(defects), the abnormalities, the non-compliance or missing noticed. Any complaint is possible only if Products are kept(preserved) in their original packing and in the required sanitary conditions. No return of the delivered Products can be made without the agreement specially(deliberately) and written by FOIE GRAS QUILLOT. The expenses of return will always be chargeable to the Customer and products will travel at his(her,its) risks and dangers; the Customer who can then ask FOIE GRAS QUILLOT only for the replacement of the non-corresponding Products or for the complement to bring to fill the missing or the refund(repayment) the aforementioned Products, without that the Customer can aspire to a some compensation(allowance) or damages. On no account, the delivered Products can be the object of a resumption of our part if no reserve or observation was formulated for the above-mentioned periods(delays). Also, the treatment, the transformation(conversion) or the modification in any way, delivered Products, is worth renunciation of any appeal against us whatever nature it is. The complaint emitted(uttered) by the Customer according to the modalities described by the present article does not suspend the payment of the concerned Products.

VI.FACULTY(POWER) OF RETRACTIONION

In application of provisions of the article L 121-16 of the Code of the consumption, you have a period(delay) of seven true days as from the day of the reception of products commanded(ordered) to make it return for FOIE GRAS QUILLOT at the following address:

VII.PRICE

The prices(prizes) are indicated in euro including the VAT at the rate current and do not understand(include) the expenses of delivery. Amounts in the day of the command(order) of the expenses of delivery are indicated on the site and appear on the page indicating the price of the order before final validation of this one.

FROM 300€ of purchase, postal charges are free. From 850€ of purchase, postal charges are free as well as 10 % of discount(delivery). The prices(prizes) can be modified without advance notice, articles being charged on the basis of the existing price(prize) in the day by the recording of the command(order). The total price(prize) indicated in the confirmation of the command(order) by FOIE GRAS QUILLOT is the total price(prize) of the seized command(order) expressed inclusive of all taxes and including the VAT at the rate current and the expenses of delivery.

VIII.TERMS OF PAYMENT

The price(prize) of products is payable in cash as from the confirmation of the command(order). The payment can be made on-line by bank card: visa, Mastercard
The debit(flow) on the bank card will be expressed in euro. The on-line secure payment by present bank card any safety(security) and guarantees the conservation of the confidential character of the sensitive(perceptible) data by procedures of protection and cryptolog

FOIE GRAS QUILLOT can cancel or suspend a command(order) of a Customer if this last one is insolvent or if one or some of his(her,its) invoices remain unpaid.

IX.PROPERTY RESERVE

Ownership transfer of our Products is suspended up to complete payment of the price(prize) of these by the Customer, in main thing(head teacher) and accessories, even in case of granting of payment times. Any opposite clause, in particular inserted into the general conditions of purchase, is considered not written. .

Of express agreement, FOIE GRAS QUILLOT can make play the rights which she(it) holds(detains) in conformance with the present clause of property reserve, for the one some of her(its) claims(debts), on the totality of her(its) Products in ownership of the Customer, these last ones being formally presumed to be the ones outstanding payments, and FOIE GRAS QUILLOT can resume(take back) them or claim them in compensation of all its unpaid invoices, without prejudice its right(law) of resolution of the current sales. In the case of nonpayment and unless FOIE GRAS QUILLOT prefers to ask for the full and whole execution of the sale, FOIE GRAS QUILLOT reserves the right to cancel the sale after formal demand and to claim the delivered Products, the expenses of return staying chargeable to the Customer and the made payments being acquired in FOIE GRAS QUILLOT as penalty clause

X.STRENGTH MAJOR

For the execution of this contract, FOIE GRAS QUILLOT cannot be held(retained) for person in charge of the cases of absolute necessity and their direct or indirect consequences on the goods, the packagings, the means of transportation, the hand of work. By event of Force majeure, we shall hear(understand) any fact preventing the total or partial execution of the command(order) which could not be surmounted in spite of a reasonable diligence on behalf of FOIE GRAS QUILLOT or of his(her) substitutes. Will be likened in particular to cases of absolute necessity without that this list is exhaustive: the accidents affecting the production, the storage, the marketing or the transport of our Products, as well as the fire, the flood, the breaking of machines, the strikes, the war, the impossibility to be furnished with raw material, the epidemics, or break of supply for a cause not attributable in FOIE GRAS QUILLOT as well as quite other cause of break of attributable supply to our suppliers

XI.APPLICABLE RIGHT(LAW)

All the clauses appearing in the present general conditions of sale as well as all the operations of purchase and sale which are aimed at it will be subjected to the French law. In case of dispute, the Customer will address by priority FOIE GRAS QUILLOT to find an amicable solution. In defect, the affair(business) will be carried(worn) in front of the jurisdictions compétentes.-Confidentiality - Protection of your particulars. According to the IT law and freedom, the particulars which you communicate are treated(handled) and stored in conditions aiming at assuring(insuring) the safety(security) of the information. In application of the IT law and Liberties of January 6th, 1978, you have at any time a right of access, modification or abolition(deletion) in the particulars concerning you. Also, these particulars will not be communicated with thirds(third parties).
